Treasury Wine Estates has secured a final and landmark intellectual property infringement decision in China against Rush Rich – a copycat wine operator that engaged in unauthorised use of our trademarks and misleading market conduct. The Chinese court ordered the defendants to cease all infringing use of BEN FU / 奔富 – the Chinese name for Penfolds – and awarded TWE AUD14.5 million in damages, representing one of the highest intellectual property damages awards ever granted by the Chinese courts.
